StenoWorks Limited Warranty for Pre-Owned Writers

This Limited Warranty applies only to qualifying pre-owned writer equipment sold by StenoWorks, Inc. (“StenoWorks,” “we,” “our,” or “us”) to the original purchaser (“Buyer” or “you”), unless a different warranty term is expressly stated in writing by StenoWorks for a specific product.

1. Limited Warranty Coverage

Subject to the terms, conditions, exclusions, and limitations set forth below, StenoWorks warrants that the covered pre-owned writer product (the “Writer”) will, for a period of one (1) year from the date of purchase, be free from defects in workmanship under normal use and will substantially perform in accordance with the manufacturer’s applicable functional specifications for that Writer.

Because the Writer is pre-owned equipment, this Limited Warranty does not cover cosmetic conditions, including without limitation scratches, dents, discoloration, worn keytops, faded markings, minor finish wear, or other ordinary wear and tear that do not materially impair functionality.

2. Who Is Covered

This Limited Warranty extends only to the original purchaser of the Writer from StenoWorks and is not transferable without StenoWorks’ prior written consent.

3. Buyer’s Sole and Exclusive Remedy

If a covered defect arises during the warranty period, Buyer must notify StenoWorks before the warranty period expires and follow StenoWorks’ troubleshooting, diagnostic, and return procedures.

If, after inspection, testing, and evaluation, StenoWorks determines that the Writer has a defect covered by this Limited Warranty, StenoWorks will, at its sole option:

repair the Writer;
replace the Writer with the same model or a comparable model of equal or greater functional value; or
refund the original purchase price actually paid for the Writer.

THESE REMEDIES ARE BUYER’S SOLE AND EXCLUSIVE REMEDIES for any breach of this Limited Warranty.

4. Warranty Claim Procedure; Return Authorization; Shipping

Prior authorization from StenoWorks may be required before return of a Writer for warranty inspection or service. StenoWorks may require Buyer to provide proof of purchase, a written description of the claimed defect, photographs, video, remote troubleshooting cooperation, or other information reasonably requested to evaluate the claim.

Unless otherwise required by applicable law or expressly agreed by StenoWorks in writing:

Buyer is responsible for the cost of shipping the Writer to StenoWorks for warranty evaluation.
If StenoWorks confirms a covered defect, StenoWorks will pay the cost of standard return shipping to Buyer within the continental United States.
Expedited shipping requested by Buyer is at Buyer’s expense.
For international warranty claims, Buyer is responsible for all shipping charges, duties, taxes, customs fees, brokerage fees, and related costs.

If inspection or testing shows that no covered defect exists, or that the issue is excluded from coverage, StenoWorks may charge reasonable inspection, testing, handling, repair, and return-shipping fees.

5. What Is Not Covered

This Limited Warranty does not cover:

consumable, limited-life, or routinely replaced items, including without limitation ribbons, batteries, chargers, cables, cases, memory media, power adapters, and similar accessories, unless expressly stated otherwise in writing;
normal wear and tear or cosmetic conditions that do not materially impair functionality;
damage caused by misuse, abuse, negligence, accident, dropping, liquid exposure, improper transport, improper storage, improper maintenance, improper cleaning, power surges, improper electrical supply, or unauthorized installation;
damage caused by alteration, tampering, attempted repair, modification, or service by anyone other than StenoWorks or a service provider expressly authorized in writing by StenoWorks;
damage caused by use with non-approved, incompatible, or defective accessories, peripherals, software, firmware, systems, or power supplies;
loss or corruption of data, files, settings, or recordings;
any issue that does not materially affect the Writer’s core intended function;
products sold “as is,” “for parts,” or with express written exclusion of warranty coverage;
damage occurring after shipment that results from improper handling, storage, setup, maintenance, or use by Buyer or any third party; and
damage or failure caused by events beyond StenoWorks’ reasonable control.

6. Technical Support

During the warranty period, StenoWorks will provide phone technical support during regular business hours for the covered Writer and may provide access to its online support ticket system, subject to StenoWorks’ then-current support practices, procedures, and business hours.

Technical support is intended to assist with diagnosis and use and does not expand the scope of this Limited Warranty.

7. Disclaimer of Other Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY IS THE ONLY WARRANTY PROVIDED BY STENOWORKS FOR THE COVERED WRITER, AND STENOWORKS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

If an implied warranty cannot be disclaimed under applicable law, it is limited to the duration of this Limited Warranty or the minimum period required by law, whichever is longer.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STENOWORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF USE, LOSS OF BUSINESS, LOSS OF REVENUE, LOST PROFITS, LOST SAVINGS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE WRITER OR THIS LIMITED WARRANTY, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STENOWORKS’ TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE WRITER OR THIS LIMITED WARRANTY SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY BUYER FOR THE WRITER.

9. No Oral Modifications; Entire Warranty

No employee, dealer, agent, reseller, or representative of StenoWorks is authorized to modify, extend, or create any warranty unless in a written document signed by an authorized officer of StenoWorks.

This Limited Warranty states StenoWorks’ entire warranty obligation for the covered Writer and supersedes any prior or contemporaneous oral statements and any inconsistent written statements regarding warranty coverage for the Writer.

10. Legal Rights

This Limited Warranty gives Buyer specific legal rights, and Buyer may also have other rights that vary by state, province, or country. Some jurisdictions do not allow certain exclusions or limitations of implied warranties or damages, so portions of this Limited Warranty may not apply to Buyer.

11. Severability

If any provision of this Limited Warranty is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.
